1. Scope
These General Terms and Conditions (hereinafter "GTC") apply to the use of the ticketing platform "ticketing.li," operated by KULMAG Kulturmanagement AG, Alemannenstrasse 23, 9485 Nendeln, Principality of Liechtenstein (hereinafter "Operator"). The platform is used for the sale of tickets for cultural events, primarily concerts.
2. Contracting Parties and Services
(1) The ticketing platform facilitates and sells tickets for various events. Tickets may be offered by different institutions but are only added to the system after verification by the Operator. (2) The contract for the purchase of a ticket is concluded directly between the customer and the respective event organizer. The Operator acts as an intermediary and handles the payment process. The Operator has no influence on the execution of the event and is not the organizer of the events offered on the platform.
3. Conclusion of Contract
(1) By clicking the "Pay" button in the shopping cart, the customer submits a binding offer to conclude a contract with the respective event organizer. The Operator acts as a technical service provider for ticket sales and assumes no responsibility for the execution of the event. (2) The contract for attending the event is only concluded upon confirmation of the ticket purchase and the dispatch of the ticket by the Operator on behalf of the organizer. (3) The contract is only fully completed once payment has been successfully made and confirmed. The customer is only entitled to the ticket after full payment and dispatch by the Operator.
4. Registration and User Account
(1) The use of the platform requires the registration of a user account. (2) The user is obliged to provide truthful information and keep their login credentials secure. (3) The Operator reserves the right to suspend or delete user accounts in case of suspected misuse or violations of the GTC. (4) The user may request the irreversible deletion of their account and associated personal data by contacting the Operator via email at info@ticketing.li.
5. Ticket Purchase, Prices, and Payment Processing
(1) Ticket prices are set by the respective event organizers. Additionally, service fees may be charged by the Operator. Certain event organizers may be exempt from these fees, which may vary by organizer. (2) Ticket prices may exceed the printed ticket price. (3) Ticket prices and fees include statutory VAT. (4) Payments are processed via the payment service provider Payrexx AG, Burgstrasse 20, 3600 Thun, Switzerland. The terms and conditions and data protection policies of Payrexx, available at www.payrexx.com, apply to the processing of payment data. (5) The customer agrees that their payment data will be transmitted to the payment service provider for transaction processing. (6) The total price, including all fees, is due immediately upon contract conclusion. After successful payment, the customer will receive the ticket via email to the address provided. (7) Seating or venue maps displayed during the ordering process are for orientation purposes only and do not represent a true-to-scale depiction of the venue. The actual seating arrangement may differ. Complaints due to discrepancies in seating representation are excluded.
6. Cancellation, Rebooking, and Refunds
(1) Ticket cancellations or refunds are excluded. (2) If an event is canceled or postponed, it is at the discretion of the respective event organizer whether a refund or validity of the tickets for a rescheduled date will be granted. (3) If an event is relocated (e.g., from open-air to indoor), certain ticket categories may remain valid as determined and communicated by the organizer.
7. Ticket Delivery and Entry
(1) Tickets are sent via email to the address provided by the user. (2) Tickets are generally not personalized. (3) Admission to the event is granted by the respective organizer, who checks the validity of the ticket.
8. Disclaimer and Limitation of Liability
(1) The Operator is not liable for the execution, quality, or content of the events. (2) Any claims related to the event must be directed to the event organizer. (3) The Operator is not liable for losses or damages resulting from incorrect or inaccurate information provided by the event organizer, particularly regarding date changes, canceled events, or incorrect pricing on the platform. (4) The Operator is not liable for technical disruptions beyond its control (e.g., server failures, network outages, force majeure). (5) The customer is responsible for keeping their ticket secure. The Operator assumes no liability for lost, stolen, or fraudulently used tickets. (6) Liability for indirect damages, lost profits, or other consequential damages is excluded. (7) The platform uses Payrexx AG for payment processing and is not liable for errors or delays caused by the payment service provider.
9. Data Protection
(1) Personal data provided during registration and ticket purchase history are stored. (2) Data will generally not be shared with third parties, except for event organizers, who may receive the contact details (name, address, email, phone number) of ticket buyers for their event.
10. Regulations for Attending Events
10.1 General Provisions. These regulations apply to all events unless otherwise stipulated by the respective event organizer.
10.2 Admission and Conduct Rules. Visitors must comply with the regulations set by the organizer or venue, including house rules, staff instructions, and official announcements. Violation of these rules or disruptive behavior may result in denied entry or expulsion from the event.
10.3 Security Checks. The organizer or assigned security personnel have the right to conduct random checks of persons or carried items to ensure event security.
10.4 Recordings by the Organizer. Photo, video, or audio recordings may be made during an event, capturing visitors as part of the audience. Visitors should inform themselves about the organizer's policies before purchasing tickets.
10.5 Visitor Recordings. Creating and using images or audio recordings is subject to the organizer's regulations. In particular, commercial recordings are prohibited without prior written approval from the organizer.
10.6 Carrying Items and Consumption. Bringing certain items (e.g., laser pointers), animals (except guide dogs), or outside food and beverages may be prohibited by the organizer or venue. Visitors should check relevant policies in advance.
10.7 Late Arrival and Leaving the Event. Late-arriving visitors are not entitled to immediate admission and may only be admitted at an appropriate time, such as during an intermission. Visitors who leave the venue early may be denied re-entry.
11. Transfer of Tickets
(1) The transfer of tickets to third parties is permitted only on a private basis. (2) The resale of tickets for profit is prohibited. In particular, purchasing tickets with the intent to resell them at a higher price is not allowed. (3) The Operator reserves the right to cancel orders and affected tickets and suspend user accounts if a violation of this rule is detected.
12. Applicable Law and Jurisdiction
(1) The law of the Principality of Liechtenstein applies. (2) The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC is Vaduz, Liechtenstein.
13. Final Provisions
(1) If any provisions of these GTC are or become invalid, the validity of the remaining provisions remains unaffected. (2) The Operator reserves the right to amend these GTC at any time. The current version will be published on the website.
